Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms and Conditions:

• Application refers to GlowScan AI, the software program provided by the Company downloaded by You on any electronic device.
• Company (referred to as either "the Company", "We", "Us" or "Our") refers to GlowScan AI.
• Content refers to content such as text, images, or other information that can be posted, uploaded, linked to or otherwise made available by You.
• Service refers to the Application.
• Subscription refers to the services or access to the Service offered to You by the Company on a recurring paid basis.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. By accessing or using the Service You agree to be bound by these Terms and Conditions.

You represent that you are over the age of 13. The Company does not permit those under 13 to use the Service. If you are between 13 and 18 years old, you represent that your legal guardian has reviewed and agreed to these Terms.

• • To share your account credentials with others

We reserve the right to terminate Your use of the Service for violating any of the prohibited uses.

Skin Analysis and AI Services

Nature of AI Analysis

The skin analysis provided by Our Service uses artificial intelligence technology to analyze uploaded photos and provide skincare recommendations. You understand and acknowledge that:

• • Results are not medical diagnoses and should not replace professional medical advice
• • The accuracy of analysis depends on photo quality, lighting conditions, and other factors
• • Individual results may vary and are not guaranteed

Photo Uploads and Consent

By uploading photos to Our Service, You:

• • Confirm that You have the right to upload and share the photos
• • Grant Us permission to process and analyze the photos using AI technology
• • Understand that photo sharing for AI model improvement is optional and controllable
• • Acknowledge that analysis results will be stored for progress tracking purposes

Medical Disclaimer

Our Service is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The information provided by Our Service should not be considered medical advice. Always consult with a qualified healthcare professional before making decisions about your health or skincare routine.

Subscriptions and Payments

Subscription Services

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis, depending on the type of subscription plan you select.

At the end of each billing period, Your Subscription will automatically renew under the exact same conditions unless You cancel it or the Company cancels it.

Free Trial

The Company may, at its sole discretion, offer a Subscription with a Free Trial for a limited period of time. You may be required to enter Your billing information to sign up for the Free Trial.

On the last day of the Free Trial period, unless You cancelled Your Subscription, You will be automatically charged the applicable Subscription fees.

In-App Purchases

The Application may include In-App Purchases that allow you to buy products, services or Subscriptions. In-App Purchases can only be consumed within the Application and cannot be cancelled after you have initiated the purchase process.

Intellectual Property Rights

The Service and its original content, features and functionality are and will remain the exclusive property of the Company and its licensors. The Service is protected by copyright, trademark, and other laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes, subject to these Terms.

User Data and Privacy

We respect Your privacy and are committed to protecting Your personal data. Our collection and use of personal information in connection with Your use of the Service is described in Our Privacy Policy.

By using Our Service, You consent to the collection and use of Your information as described in Our Privacy Policy, including:

• • Collection of onboarding questionnaire responses
• • Processing of skin analysis photos and results
• • Use of analytics services like Mixpanel for service improvement
• • Storage of usage data and progress tracking information

Termination

We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your Account, You may simply discontinue using the Service.

Limitation of Liability

The entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven't purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company expressly disclaims all warranties, whether express, implied, statutory or otherwise.

Governing Law

The laws of the United States, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms.
